Welcome to ACCESSLY Creators. By accessing or using the ACCESSLY Creators mobile app, website, or services, you agree to be bound by these Terms & Conditions. ACCESSLY Creators is a premium creator-led activities and experiences platform for discovering, joining, and participating in structured public group activities. This website is informational only — all registrations and transactions occur exclusively through the ACCESSLY Creators mobile application.
1. Platform Overview
ACCESSLY Creators connects participants with verified creators, coaches, instructors, performers, athletes, mentors, and community leaders offering structured public group experiences. ACCESSLY Creators facilitates discovery, experience listings, participation management, communication, and activity-based community engagement through the mobile application. ACCESSLY Creators is not the creator, host, venue, employer, agent, insurer, or guarantor of any listed experience unless expressly stated. This website serves an informational purpose only.
2. User Eligibility
You must be legally able to enter into these Terms. If you are under the age of majority in your jurisdiction, you may use ACCESSLY Creators only with parent or guardian consent. You agree to provide accurate name, email, mobile number, profile, and payment-related information and to keep it updated.
3. Accounts and Security
You are responsible for activity under your account and for keeping your login credentials secure. You must not impersonate another person, create misleading profiles, use another user's account, or use ACCESSLY Creators for fraudulent, abusive, unlawful, or unauthorized purposes.
4. Bookings and Real-World Experiences
Bookings are for real-world experiences or services described by creators. Availability, capacity, venue rules, ID requirements, date, time, duration, amenities, and participation conditions may vary by listing. Users must review the listing, creator rules, cancellation policy, and refund policy before paying.
5. Auctions and Bidding
Certain experiences may use auction-based access. Placing a bid means you agree that, if you win, you are responsible for completing the final payment within the required time. ACCESSLY Creators may cancel bids, auctions, or participation in cases of suspected manipulation, fraud, non-payment, abuse, listing error, or policy violation.
6. Payments
Payments are processed through Razorpay or other payment processors we may support. ACCESSLY Creators does not store card, UPI, wallet, or banking credentials. Payment records may include order ID, payment ID, amount, status, and verification result. You authorize ACCESSLY Creators and its payment partners to process payments, refunds, and related records for bookings, auction participation, and final payments.
7. Creator and Talent Onboarding Terms
Creators who publish experiences agree that all listing details are accurate, lawful, and not misleading, including creator name, images, category, title, description, media, date, time, duration, amenities, capacity, safety rules, ID requirements, city, venue, address, pricing, auction details, cancellation policy, and refund policy. Creators are responsible for obtaining rights to uploaded media, complying with venue and local rules, fulfilling confirmed experiences, communicating professionally, honoring published policies, and cooperating with support for disputes, QR verification, cancellations, and refunds.
8. Creator Payouts and Withheld Amounts
Creator payouts, if available, may be subject to payment verification, completion confirmation, QR or order verification, refund windows, chargebacks, disputes, taxes, platform fees, payment processor fees, and compliance checks. ACCESSLY Creators may delay, withhold, reverse, or adjust payout amounts where required for fraud prevention, dispute resolution, legal compliance, cancellation, non-fulfillment, or policy violations.
9. User Conduct and Safety
Users and creators must act respectfully and safely. Harassment, threats, hate speech, sexual misconduct, stalking, doxxing, discrimination, illegal activity, violence, unsafe conduct, spam, payment circumvention, misleading listings, and abuse of support or dispute processes are prohibited.
10. Prohibited Listings and Activities
Listings and activities must not involve illegal goods or services, weapons, controlled substances, prostitution, escort services, compensated companionship, sugar dating, adult sexual services, dating-for-payment arrangements, private companionship solicitation, exploitative content, dangerous activities without proper safeguards, medical or financial guarantees, misleading celebrity access, unauthorized ticket resale, gambling, or any activity that violates law, payment processor rules, app store policies, or ACCESSLY Creators policies. ACCESSLY Creators is strictly intended for creator-led public experiences, workshops, events, performances, community activities, and entertainment experiences, and may not be used to arrange private companionship or paid personal relationships of any kind.
11. Refunds and Cancellations
Refunds and cancellations are governed by the listing terms, creator policies, ACCESSLY Creators's Refund Policy, payment processor rules, and applicable law. ACCESSLY Creators may review exceptional cases such as duplicate payments, failed payments, creator cancellation, non-fulfillment, safety concerns, or fraud.
12. Intellectual Property
ACCESSLY Creators's name, branding, interface, software, and platform materials are owned by ACCESSLY Creators or its licensors. Users retain ownership of content they upload but grant ACCESSLY Creators a worldwide, non-exclusive license to host, store, display, process, promote, and distribute that content as needed to operate and market the platform.
13. Availability and Changes
ACCESSLY Creators may modify, suspend, remove, or discontinue features, listings, accounts, payments, or services at any time where needed for operations, safety, compliance, fraud prevention, or business reasons. We may update these Terms, and continued use after updates means you accept the revised Terms.
14. Limitation of Liability
To the maximum extent permitted by law, ACCESSLY Creators is not liable for indirect, incidental, special, consequential, or punitive damages; missed experiences; creator conduct; venue issues; user disputes; payment gateway downtime; network failures; or losses caused by events outside our reasonable control.
15. Messaging, Reporting, and Blocking
ACCESSLY Creators may provide in-app messaging, communication tools, reporting systems, moderation tools, and blocking functionality. Users agree not to use messaging for harassment, abuse, spam, threats, fraud, solicitation, hate speech, stalking, sexual misconduct, or unlawful activity. ACCESSLY Creators may review reports, restrict accounts, remove content, disable messaging access, suspend accounts, or cooperate with authorities where necessary for safety, legal compliance, fraud prevention, or platform integrity.
16. Off-Platform Payments and Circumvention
Users and creators must not bypass ACCESSLY Creators's payment systems for transactions originating through the platform. Requesting direct bank transfers, external UPI payments, cash payments, crypto payments, or off-platform payment arrangements intended to avoid platform fees, verification systems, dispute handling, moderation, or platform policies may result in cancellation, payout withholding, account restrictions, or permanent suspension.
17. Fraud, Chargebacks, and Abuse Prevention
ACCESSLY Creators may investigate suspected fraud, fake bookings, manipulated auctions, payment abuse, chargeback abuse, fake profiles, identity misuse, refund abuse, fake disputes, fake experiences, unauthorized payment activity, bot activity, spam behavior, or policy circumvention. ACCESSLY Creators may suspend transactions, reverse payouts, restrict accounts, remove listings, withhold funds, request identity verification, or cooperate with payment processors, banks, law enforcement, and regulatory authorities where appropriate.
18. Identity Verification and User Responsibility
ACCESSLY Creators does not independently guarantee the identity, background, qualifications, legality, safety, authenticity, intentions, or conduct of users, creators, venues, guests, or attendees unless expressly stated. Users are responsible for exercising reasonable judgment and personal safety precautions before participating in real-world experiences, communications, or payments.
19. Real-World Safety Disclaimer
Experiences may involve real-world interactions, venues, travel, crowds, physical activity, third-party services, or public events. Users participate at their own discretion and risk. ACCESSLY Creators is not responsible for injuries, accidents, venue disputes, theft, misconduct, transportation issues, weather disruptions, crowd incidents, unsafe conditions, emergency situations, creator conduct, attendee conduct, or events outside our reasonable control.
20. Creator Non-Fulfillment and No-Show Policy
If a creator fails to fulfill an experience, materially changes the experience without approval, fails to appear, repeatedly cancels bookings, violates policies, engages in fraud, or creates safety concerns, ACCESSLY Creators may suspend listings, delay payouts, issue refunds where appropriate, restrict creator access, or permanently remove creator accounts.
21. Account Suspension and Termination
ACCESSLY Creators may suspend, restrict, disable, or permanently terminate accounts, listings, auctions, messages, bookings, or platform access where necessary for policy enforcement, legal compliance, fraud prevention, payment risk management, safety concerns, abuse, impersonation, intellectual property violations, suspicious activity, or operational reasons. Users may also request account deletion subject to legal, payment, fraud prevention, tax, safety, dispute, and record retention obligations.
22. User Content and Media
Users and creators remain responsible for uploaded content including images, videos, descriptions, bios, social links, profile information, reviews, messages, and promotional materials. Content must not infringe intellectual property rights, privacy rights, publicity rights, trademark rights, or applicable laws. ACCESSLY Creators may remove, restrict, moderate, review, or disable content that violates policies or creates legal, operational, reputational, or safety concerns.
23. Prohibited Impersonation and Misleading Activity
Users may not impersonate celebrities, creators, public figures, organizations, brands, athletes, influencers, mentors, businesses, or other persons without authorization. Fake identity usage, deepfakes, manipulated media, misleading listings, fake endorsements, fake engagement, deceptive promotions, or misrepresentation of access or affiliation are prohibited.
24. Taxes and Compliance
Users and creators are responsible for complying with applicable tax laws, invoicing rules, reporting obligations, permits, licenses, venue requirements, and local regulations related to their participation, bookings, earnings, or activities. ACCESSLY Creators may collect, verify, process, or share compliance-related information where required by law, payment processors, regulators, or operational requirements.
25. Platform Changes and Feature Availability
ACCESSLY Creators may modify platform features, fees, interfaces, pricing systems, payment flows, auctions, messaging systems, moderation systems, creator tools, availability, or platform functionality at any time. Certain features may be experimental, region-limited, beta-based, temporarily unavailable, or discontinued without liability.
26. Governing Law and Disputes
These Terms are governed by the laws applicable in the jurisdiction determined by ACCESSLY Creators. Users agree that disputes relating to the platform, payments, bookings, auctions, creators, messaging, moderation, or services may be resolved through courts or dispute resolution mechanisms determined by applicable law and platform requirements.
27. Force Majeure
ACCESSLY Creators is not responsible for delays, failures, cancellations, outages, or disruptions caused by events beyond reasonable control including natural disasters, strikes, internet failures, payment network outages, pandemics, government restrictions, venue closures, civil unrest, war, labor disputes, cyberattacks, infrastructure failures, or third-party service disruptions.
